General Terms
All hosting packages sold via ByteBox are the property of ByteBox, the business proprietors of ByteBox.  Content held upon a ByteBox server must be deemed suitable.  We do not allow Adult or illegal content.  ByteBox reserve the right to refuse any content that is deemed unsuitable by the ByteBox team.  Any users storing or displaying unsuitable content may be suspended and will be asked to remove the content.  Should the issue be unresolved, ByteBox obtain the right to remove some or all of the user's content from the server without back-up or notice and cancel the user's account.  No refunds will be applicable where a user has contravened these terms. 

You may not store more data in your account than your allotted server space.  If you begin to run out of space, please consider upgrading your hosting package to prevent any issues.

Your server space and ftp account is for your personal use only. You must not divulge the password to any other person, and you should take reasonable precautions to ensure that it is not discovered by other people. 

ByteBox are not responsible for the back-up of your websites, unless you have opted for our maintained website packages. It is recommended that you keep an independent backup of all data stored on your web space should it be required for restoring data.  You are fully responsible for your content and data, unless you have opted for our maintained website packages.

You may not run BitTorrents from our server.

You may not run server processes (eg. talkers/IRC Bots) from your web space. 

We shall not be held liable for any loss or damages caused by the use or misuse, unavailability or removal of services. 

When your account is closed, all files (including web pages, etc.) will be deleted. 

We reserve the right to cancel your account at any time without notice. 

We reserve the right to amend and update these Terms and Conditions at any time without notice.

To protect your privacy we never distribute your name or e-mail address to any third parties without your full permission. 

Users must not participate in any form of un-solicited bulk e-mailing or spam. 

By logging into your account, or uploading files to it, you are indicating your acceptance of these Terms and Conditions.

Bandwidth
ByteBox operates a fair use policy and therefore offers unrestricted use of bandwidth. However, should your bandwidth reach the points where it has an adverse affect on other clients we reserve the right to disable your site until you can reduce your bandwidth usage.  Whilst we will make every effort to avoid this, if it is necessary to do so, your account may be cancelled without refund.
Webspace
ByteBox operates a fair use policy and therefore offers unrestricted use of webspace, unless otherwise stated in the hosting package description. However, should your disk usage reach the points where it has an adverse affect on other clients we reserve the right to disable your site until you can reduce your disk space usage.  Whilst we will make every effort to avoid this, if it is necessary to do so, your account may be cancelled without refund.
Web hosting from ByteBox is intended for serving websites and web applications.  It should not be used for online storage purposes alone (i.e. all files should relate directly to the website being hosted).
Domain Name Registration
Domain Names are registered by ByteBox on your behalf using a third-party Domain Name Register.


Web Pages
Commercial use of web and ftp space is permitted. 

You will be responsible for the content of your pages, including obtaining the legal permission for any works they include and ensuring that the contents of these pages do not violate UK law, or any other laws applicable within the United Kingdom. 

You will be held responsible for and accept responsibility for any defamatory, confidential, secret or other proprietary material available via your page(s). 

We reserve the right to remove material deemed inappropriate from your web pages, without prior notice. ByteBox do not allow adult or illegal content on our servers. 

Cancellation and Refunds 
When an account termination request is received it will only be actioned if it contains enough proof that we know it came from the authorized account holder. Such information required is: account / order number, username, password.
When an account termination request is received it will be terminated immediately. We do not accept termination requests that request closure at a future date. All termination requests must be made via support@bytebox.co.uk
All annual packages must be paid for in full up front, for 12 month periods at a time.  Monthly packages are charged per month via Paypal Subscription.   The period of commitment, and service period, is equivalent to the payment period. If you cancel your account within your service period then ByteBox will not make any refunds on any unused portions of your account. While we do not offer refunds for pro-rated service you have no obligation to continue using our service. 

ByteBox reserves the right to cancel the service at any time.  

Indemnification
Customer agrees that it shall defend, indemnify, save and hold ByteBox harmless from any and all demands, liabilities, losses, costs and claims, including reasonable solicitors fees asserted against ByteBox, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless ByteBox against liabilities arising out of:

(1) any injury to person or property caused by any products sold or otherwise distributed in connection with ByteBox' server.
(2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party.
(3) copyright infringement.
(4) any defective products sold to customer from ByteBox' server. 

Disclaimer
ByteBox will not be responsible for any damages your business may suffer, ByteBox makes no warranties of any kind, expressed or implied for services we provide. ByteBox disclaims any warranter merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, viruses and any and all service interruptions caused by ByteBox and its employees.

ByteBox reserves the right to revise the above terms and conditions at any time.
